THE REGULATIONS OF THE WEBSITE WWW.ROOMMY.COM

§ 1

Introduction

This regulations apply in respect of using and functioning the Website roomy.com (www.roommy.com). Both the terms of the Regulations with any annexes which are integral parts of the Regulations, and UE legal regulations determine the rights and the obligations of all Website Users and the rights, the obligations and the range of responsibilities of all entities authorized to run and administer all services which are being provided by Roommy.com.

§ 2

Definitions

All words and expressions starting with a capital letter (which are defined below) shall be understood only in the following way:

The Regulations - this document with all annexes that are clearly connected with the Regulations; the Regulations are in the form of all kinds of electronic files, and they are displayed and published in Roommy.com or partner websites of Roommy.com;

Website - it is a social, matrimonial and entertainment website Roommy.com (www.roommy.com) which is the Internet platform consisting of elements which are suitable and necessary for a proper functioning of a website with a complex services which are provided to Users by the Internet;

Administrator - it is an entity which administers and runs a website, in this case, it is Egelados Entertainment or/and a company /a person cooperating with Egelados Entertainment;

The patron of roommy.com - an entity administering and running a website, in this case, it is Egelados Entertainment or/and a company /a person cooperating with Egelados Entertainment;

E-mail box - it is the Internet mail box which is characterized by a unique Internet address of a person/a User (e-mail address). It is used for sending and receiving messages and other data via the Internet (by sending information in the form of attachments).

User - a natural person above 15 who can correctly and effectively create his/her Account on the Website on his/her own or with the help of the Administrator by obtaining his/her Login/Nick and password enabling to log in;

Login, Nick - an individual and unique User's name that is chosen by a user or proposed by the Website if during the registration the name that is chosen by a User turns out to be unavailable;

Account - it is a place on the Website that is available for a particular User after logging in (inserting a correct Login and password which must be consistent with the data that had been registered in the system); an Account enables a User to input and administer information, descriptions, and other elements which are connected with the activities on the Website (for example, the activation and deactivation of particular services, etc.);

Profile - information presenting and describing a particular User; the data are supplied consciously, on a User's own and of a User's own free will; with the prior consent of a User, the data are accessible and presented on a User's page on the Website. A User's Profile is visible both when a User is logged in and after a User's log out;

User's Page - a User's unique Internet address on the Website (of the following configuration: www.roommy.com/section/nick). The page contains information from a User's Profile (information which were supplied consciously, on a User's own and of a User's own free will); Thanks to this place/address other Users, and in some cases, people using the Internet who are not Users of the Website can observe a User's profile;

Users' Profiles Database - the collection of all multimedia data, information and contents supplied consciously, voluntarily and independently by all Users to the Website. This collection is processed in the IT system by the Administrator with the prior consent of Users, which is done for the purposes of providing the Website services, including marketing services and database services of Egelados Entertainment and cooperating companies;

Piggies - the Website service that is available for all Users who after paying a fee gain for a limited period of time a possibility of using Piggies which are virtual points that enable Users to perform available and required activities. Piggies enable Users to use some extended or additional services and preferences which are granted for a limited period of time or in a limited quantities;

Piggy Bank - the Website service that is available for all Users who want to pay a fee and supply their account with Piggies and/or supply other User's account with virtual points called Piggies after paying a certain fee. The payment chart and a converter of fees into virtual points called Piggies is in the Payment and Roomy.com Services Chart;

Help - the Website place where a User can find out how to achieve desired goals with the help of typical questions and answers or by sending a question directly to the Website Administrator, however, in the latter case, the help may be given after a longer period of time. The Administrator will help the User if there is no answer to his/her question in a typical answers in the tag'Help'. Additionally, the Administrator performs several services which are chargeable. The list of payments is in the Payment and Roomy.com Services Chart;

§ 3

Basic technical information and the terms of use the Website Roommy.com

1. The owner of the Website is Egelados Entertainment Limited

2. The Website activity is based on providing the system of presenting and exchanging multimedia data about Users in the Internet.

The aim of the Website is to enable its Users to strike up acquaintances and new contacts. Free and chargeable services or/and subscriptions are or will be provided via Roommy.com with the reservation that the services or/and subscriptions are or will be connected with the profiles and activities which are offered within the framework of the Website.

3. To use the Website services it is necessary to have devices enabling to use the Internet, e-mail box and web browsers (it is recommended to use the following web browsers which have built in rules for sending and receiving cookies: FireFox web browser, Opera web browser. We don't recommend to use Internet Explorer).

4. The membership in the Website is voluntarily and free.

Users who recommend the Website to other not registered people are responsible for the above mentioned recommendation and state that they are aware of this recommendation and its legal consequences and/or material consequences consistent with the Polish law.

5. All chargeable services are provided only at a clear and correct request of a User after his/her prior payment for a particular service in accordance with the terms described in the Piggy Bank.

6. Users' Profiles Database is under a legal protection, and personal data (in accordance with Personal Data Protection Act) which are gathered in the Users' Profiles Database are processed by Egelados Entertainment. Each User has the right to inspect his/her personal information, the right to correct the information and the right to delete the information from the Users' Profiles Database.

7. Technical terms of the use of the Website are significant for the proper functioning of the Website, its proper image in a web browser, and the safety of a User's personal information which are recorded in a User's Account. Each User shall obey the below mentioned terms and conditions, and he is exclusively liable for all actions performed (intentional or unintentional) against the terms:

a. web pages of the Website function in accordance with the technology of cookies. Cookies are text files which are recorded on hard disk in computers of people visiting the Website pages. Cookies store information and data concerning a User's use of the Website (information that, for example, enable to recognize Users on the Website or use to collect general statistical data about the way of use the Website). Users who have web browsers which don't have built in rules for sending and receiving cookies can participate in the Website, however, such web browsers can cause difficulties in the Website functioning (for example, the speed of loading a page, and even the impossibility of logging in to an Account) . That is why, it is not recommended to use computer software without built in rules for sending or receiving cookies. Moreover, cookies store information about an actual User's session on the Website, i.e. the time from the moment of logging in by inserting a login and a password to the moment of logging out via a special function LOG OUT that is available on the Website. If a User after logging in does not log out, then, after 40 minutes from the last action on the Website, the Website will log out a User automatically. During the period of time from the moment of logging in to the Website to the moment of logging out from the Website by a User or by the Website automatically, a User's Account is available for all people using the computer and those people will be able to use the Website as a logged in User, so they will have an access to all personal information of a User and his/her personal correspondence. That is why, nobody shall leave a computer which he used for logging in without logging out, because this gives other people the opportunity to surf and use the Website as a logged in User.

§ 4

Roommy.com Services

1. The Website gives Users the opportunity to present their own data, information and other contents and multimedia records (for example, photographs, visual recordings, audio recordings, etc.) which they supply consciously and voluntarily to the Website, and which are a part of their Profile. Users are granted the right to use all available activities (for example, browsing the Users' Profiles Database, adding Users, chat, e-mail, etc.) which are offered by the Website on the terms determined in the Regulations and all annexes to the Regulations;

2. Browsing the Website (the Users' Profiles Database, etc.) and using available services and activities is available for all the Internet users, with the reservation that people who are not the Users can use the Website in the way that is limited by the Administrator who does not have to provide any reasons or explanations for any limitations;

3. The Administrator is not responsible for any services provided via the Website by the third entities who provide services for Users in their own name and behalf, on the terms of the agreement with the Administrator or the Administrator's main partners. The terms of providing such services are determined by the entity providing the services and the entity is exclusively liable for the services. All remarks and complaints concerning such services shall be directed to the above mentioned entity, and all possible complaints directed to the Administrator will be delivered to the above mentioned entities;

4. All chargeable services and activities are provided only at a clear and correct request of a User and after his/her prior payment for a particular service in accordance with the terms of the Regulations and internal information of Roommy.com;

5. A full access to the Website services is reserved for the Users who will pay a required fee.

The terms of the access to services are determined in the Regulations and all annexes to the Regulations. The annexes are also all information given on the Website pages, with the restriction that the information come from the Administrator and does not belong to the content which is built by the Users;

6. Everybody can have a full access to the Website after paying an activation fee on the terms which are determined in the Regulations and all annexes to the Regulations;

7. All Users having the same or different status on the Website can have the range of access or/and the way of providing particular services on the Website changed - including already existing or/and future statuses. The changes can be implemented at any time, i.e. the Administrator can implement the changes (an addition, a modification or deletion) at any time. The above mentioned changes may cause the necessity of fulfilling some additional conditions by the Users. If a User does not consent to the above mentioned changes and does not fulfill the conditioned which are required to implement the changes, his/her services and activities will or may be limited including a temporary ban or/and a profile deletion;

8. The Administrator will inform on the Website about each change in respect of services and activities and the results of all planned or implemented changes, with the reservation that the changes will be directly connected with the quality of services that are provided to the Users;

§ 5

The Website Membership

1. A person can become a User if he/she meets the following conditions: a natural person above 15 who can on his/her own or with the help of the Administrator create his/her Account on the Website effectively and correctly by obtaining his/her Login and password enabling to log in to his/her Account.

2. Creating an Account: to become the Website User and use the Website it is necessary to have an access to the Internet, web browser, and any active e-mail box which is used for verifying newly created Profile and receiving materials from Egelados Entertainment and/or its partners. In the case of losing a password, e-mail box will be used for retrieving the password.

3. The procedure of a registration and an Account activation / a Profile activation runs at stages with the use of

E-mail box and the Website pages and a User's actions which are described at each stage of registration and in'Help', too.

4. If a User does not complete all stages of registration, and in particular, a User does not confirm his/her Account creation by the confirmation in accordance with the instructions received on the e-mail address he/she had given, then, after 7 days from receiving the e-mail from Roommy.com, a User's e-mail address and Account/Profile become invalid. So, a User will not have the possibility of continuing his/her registration.

5. A person can have only one Account on the Website. It is forbidden to cede an Account or make it accessible to other people without a clear consent of the Administrator. People violating this condition will be removed immediately.

6. By completing the procedure of registration on the Website, which results in the creation of an Account, a User assures and states that:

a) he/she read and accepted the Regulations and all annexes to the Regulations;

b) he/she submits all his/her personal data, image in the photographs and other multimedia information creating his/her Profile voluntarily and he/she agrees that his/her Profile will be made available to the public by the Administrator, which means that the access to the Profile will have or may have an unlimited group of the Internet users. The above does not include the following information:

i. e-mail address;

ii. an Account password;

iii. activation codes and other confidential access information;

iv. the precise date of birth (the system makes available to the public a User's age in years, which is automatically calculated on the basis of the precise date of birth);

v. a telephone number.

c) he/she agrees to process his/her personal information (submitted during the registration and a later edition of Profile and in other way) and personal image (in photographs and multimedia information) now and in the future by Egelados Entertainment LTD for the purposes of making the above mentioned information available to the public via their presentation on the Website. This consent includes also the permission (given to the Administrator) for using the above mentioned data, information and image for marketing, informational and statistical purposes, and for the purpose of publishing the information, data and image in such media as the Internet, the radio, the press, the television, the mobile and stationary telephony business and the advertising. However, the publication of the above mentioned information and image can take place only in such a way that the presented information do not reveal a User's name, last name or a direct contact information (without a phone number, an e-mail address).

d) he/she agrees to receive commercial information from the Administrator and the Administrator's partners.

7. Providing photographs or other multimedia information, a User states that:

a) he/she has the rights or consents which are required by legal rules in order to make a photograph or multimedia information available to the public (published) on the Website and in other media in accordance with consents granted by a User on the basis of other terms of the Regulations and this publication will not cause the violation of the third people's rights;

b) he/she agrees on the verification and the notation of photographs and multimedia information by the Administrator (without their significant modification; the procedure of notation is done automatically by the system) in accordance with the terms stated in § 8, clause 13 of the Regulations;

c) if the third parties raise any claim (in respect of violating the rights to a published photograph or an image) to the Administrator , a User is responsible for submitting a written statement which will release the Administrator from any liabilities in the above mentioned respect. If a User does not submit the above mentioned statement, the authorized organs will ask a User to submit the statement directly to them and provide the Administrator with the copy. Until the clarification of the case, the Administrator will suspend a User's Profile in such a way that it will be not visible for other Website Users. Additionally, a User loses irretrievably his/her right to use virtual points which he/she bought on the Website.

8. Information provided by a User during registration or his/her Profile edition can be moderated by the Administrator, which means that the Administrator may refuse to publish the above mentioned information on the Website, thus, the Administrator can block a User's Account or Page, if provided information are forbidden by Polish or international legal rules, the Regulations, and decorum or morality.

9. The foregoing also applies to provided photographs and multimedia information, and additionally, the Administrator may refuse to publish photographs and multimedia information by blocking a User's Page, if a photograph is bigger in size than the size acceptable on the Website, is of low quality or does not meet the Website technical conditions (too small or too large physical sizes, improper file format, etc.). A User has the right to a payable modification of photographs (changing a scale, covering other people, etc.) in accordance with the Website price list.

10. Regardless the number of provided photographs - the main photograph must present the latest image of a User, i.e. the image which enables to recognize a User in an actual time reality (for example, a photograph of a 20-year-old User presenting him at the age of 5 or 15 is acceptable, however, it cannot be the main photograph and a Profile must be completed with an additional actual photograph as a main photo). The main photo must clearly present a User, i.e. the photo shall enable to identify a User in a reality (a face with clear features or a silhouette with clear face features). If a User does not meet the above condition his/her Page will be blocked or his/her photo will not be published.

11. A User can suspend his/her Account, which will result in a temporary deactivation of a User's Page (the Page will be invisible, and other Users wanting to find the Page will be provided with the information that a User has suspended his/her Page). If a User has been keeping his/her Account suspended for more than 6 months from the date of suspension , the Account will be deleted.

12. A User can at any moment delete his/her Account on the Website in accordance with the instructions in Help. The deletion of an Account means also the deletion of a User's Profile and Page irretrievably. All paid and not used fees are not refunded. The foregoing also applies to any cost a User bears in the case of his/her voluntary signing out of the Website or the deletion of his/her Profile by the Administrator.

13. The deletion of an Account can result in terminating all or some Website services which a User paid for if the above mentioned services require that a person has an Account on the Website for the reasons of technology or the system.

14. If the Administrator discovers that a User violets the Regulations, the Administrator can block an Account or some Website services (for example, a User's Page, the possibility of adding entries into a guest book of other Users, etc.) upon inserting an explanatory note available to all Users on the Website. The Administrator will unblock a blocked Account or other blocked services at his sole discretion if a User performs tasks which the Administrator points out as a reason for the blockade, or after a particular period of time which the Administrator points out as a sanction for the violation of the Regulations, provided that a User gives a proper guarantee that he/she will observe the Regulations.

15. An Account can be deleted by the Administrator without any warnings, which results in a complete and irretrievable removal of an Account and a Profile from Users' Profiles Database, if the Administrator discovers that:

a) A User violates the Regulations;

b) A User has not logged in on the Website for 12 months since the last logging in;

c) For 6 months a User's Profile lacks a minimal amount of information required for the activation of a User's Page;

d) A User has more than one Account - in this case, all User's Accounts can be removed;

e) A User does not accept the changes in the Regulations which are introduced by the Administrator;

f) During 3 months from the blockade of an Account or other Website services by the Administrator, a User does not perform actions required for unblocking, or due to concrete circumstances a User does not guarantee the observance of the Regulations;

g) A User keeps his/her Account suspended for more than 6 months from suspension;

h) A User performs actions that even indirectly seem to interfere in the Website structures (which are out of a User's access), or a User's actions cause the destabilization of the Website operation, regardless of the way and techniques of the above mentioned actions.

§ 6

Rules

1. Without a clear consent of the Administrator, a User cannot (in any case and in any form -either directly or indirectly) provide in the contents generally available on the Website (on a User's Page, or in a guest book) any information indicating a mean or a way of a direct contact with he/she (a phone number, an e-mail address, etc). The foregoing also applies to any web page addresses. It is also forbidden to:

a) induce other Users to provide information concerning a direct contact with such a User (for example, via a guest book or the Website correspondence).

b) to inform in generally available Website places about the fact of using or not using particular Website services by a particular User.

2. It is forbidden to use the Website (its functions and its particular additional services - free and chargeable) for other purposes - inconsistent or improper - than the purposes resulting from the character of the Website. In particular, it is forbidden to:

a) spread pornographic contents;

b) conduct a commercial, advertising or promotional activity;

c) send spam messages and any commercial information that was not ordered;

d) perform actions affecting other Users or act to the detriment of other Users, the Administrator or the third parties;

e) publish on the Website any content i)violating Polish or international law, decorum or moral standards, ii)violating ones dignity or other people's personal rights, iii)supporting radical social attitudes (racial discrimination, discrimination against ethnic minorities, discrimination on the grounds of gender or religion, etc).

§ 7

Complaints

1. A User can make a complaint about the Website interferences by reporting on interferences to the Administrator or the Website Assistants -'Roommy.com Patron or Customer Service'

2. The foregoing also applies to the Website services, unless otherwise agreed in regulations concerning a service that is subject to a complaint

3. Complaints are considered without delay by the Website Service Team not later than within 14 days since the day of making a complaint, however the Administrator reserves the right to leave a complaint without an answer if a complaint concerns dysfunctions resulting from the ignorance of the Regulations, or instructions which are given without delay on the Website or directly by the Administrator.

4. The Administrator will send without delay all complaints concerning services provided by the third parties via the Website to the proper third party being responsible for handling a complaint.

5. The Administrator reserves the right to the interference in a technical structure of a User's Account for the purpose of diagnosing an incorrectness in the Website functioning. Moreover, as far as a technical structure of a User's Account is concerned, the Administrator has the right to implement changes in order to modify or repair an Account or the Website.

§ 8

Conditions, assurances and responsibility

1. The Administrator is not liable for contents (their authenticity, reliability, as well as the authenticity of photographs and multimedia information) which are provided and published on the Website by the Users.

2. The Administrator is not liable for events which may take place or had taken place in the real world between the Users who met via the Website.

3. The Administrator is not liable for the authenticity of information and data which are provided by the Users on the Website. Moreover, the Administrator is not liable for the authenticity of information about the Users which are available for the other Users. The Administrator has no possibility of verifying the above mentioned information with the facts.

4. The Administrator assures that he will not disclose or provide any third party with the information about the Users unless in a way resulting from the purpose of the Website or prior agreements or legal rules. Moreover, the Administrator assures that all the above mentioned information will be properly protected, in particular, via Personal Data Protection Act and regulations resulting from the Act.

5. Being the Website owner and manager, the Administrator assures that he will make every effort to provide the Users with a faultless working Website and its services, however, the Administrator is not liable for faults resulting from force majeure or an illicit interference of the Users or third parties.

6. For the purpose of implementing improvements, adding new services or maintaining, the Administrator reserves the right to a complete or partial Website disconnection without a prior warning given to the Users.

7. The Administrator is not liable for'Account thefts' committed by the third parties, and downloading photographs and multimedia information from the Website and inserting them on other websites or using them in a different way by the third parties, because the Administrator has no possibility to block copying photographs and multimedia information from the Website.

8. The Administrator is not liable for the loss of the Website data (gathered in the Administrator's computer systems) which is caused by an equipment failure, the Internet dysfunction, or the third parties' actions.

9. The Administrator reserves the right to publish on the Website information about the Users who are continuously violating the Regulations.

10. The Administrator reserves the right to publish anonymous notes (which are worth publishing in the opinion of the Administrator) sent to the Website Service Team by the Users. The notes concerns issues connected with the Website working (FAQ), providing advice, etc.

11. The Administrator reserves the right to use all Website functions including the system of an internal mail to run a commercial and advertising activity among the Users and the third parties, in particular by sending or adding to e-mails (which are sent among the Users and the third parties) some advertising, informational and commercial contents concerning products and services provided by both the Administrator and the third parties. Thus the Users agree on adding advertisements to e-mails which are sent via the system of an internal mail.

12. Without the Administrator's written consent it is forbidden to copy or duplicate any information, data, other contents, multimedia information and photographs from the Website in entirety or in parts, with the exception of an allowed use resulting from the Act on Copyright and Neighboring Rights.

13. Due to the character of the Internet (its features, for example, unpredictable directions and possibilities of the development of danger technologies, expanse, impossibility of verifying with the facts, anonymity), the Administrator reserves the right to implement any functional, identity and other solutions on the Website in connection with possible undesirable behaviors and events which may threaten the rights and interests of the Users, the Administrator or other entities. In particular, the Administrator reserves the right to mark materials provided by the Users for the purpose of counteracting the use of the above mentioned materials in a way that is inconsistent with the Users' will by any entities not authorized to use the materials. Each User can ask the Administrator to stop such solutions toward materials provided by him/her, and the Administrator can refuse such a request only in the case if the request violates the interests of the Administrator or the third parties.

14. The Administrator reserves the right to assign (partially or entirely) all his rights and responsibilities connected with the Website without the User's consent and without the possibility of raising objections by the Users.

§ 9

Changes in the Regulations

1. Any terms of the Regulations can be changed by the Administrator at any time without specifying the reasons for changes. All changes are published in the form of a standardized Regulations with information about the implementation of changes on the Website.

2. After publicizing information about the Regulations changes on the Website home page or other places intended for such information, a User shall immediately read the changes because his/her logging in on the Website after such information means his/her unconditional acceptance of a new Regulations content.

3. If a User does not accept the Regulations changes he/she shall not log in on the Website and immediately inform the Administrator about his/her decision.

4. The statement on the lack of acceptance of changes in the Regulations results in deleting a User's Account.
